As You Re-Open, Time to Review Your Attendance Policies and Employee Handbook

We hope that the start of re-opening is a good sign for your business. As you begin to bring employees back to work, or as you look at ongoing remote work for members of your staff, the employment regulation landscape has changed drastically since the start of the pandemic shutdowns.

Here in NYS, we have been dealing with FMLA for decades, and more recently, we have been working with Paid Family Leave. Now, we have FFCRA with Expanded FMLA, NYS Covid 19 Paid Sick Leave, and others. What you may have missed is that NYS slipped a permanent Paid Sick Leave Law into the budget that was passed on April 3, 2020. The new law begins to go into effect on September 30, 2020, with employees being allowed to take sick time under this law starting in January 2021. Final regulations are not available, but you should begin planning now. If your sick time policy is more restrictive than the new law, you’ll probably need to make adjustments.
